By using the Invicta Health Learning Management System (IHLMS),  delegates agree to the following Terms and Conditions, our Cancellation Policy and Privacy Notice.

The following constitute the Terms and Conditions to which delegates agree when booking any IHLMS training or using any e-learning courses. Invicta Health reserves the right to review and update these Terms and Conditions periodically to comply with law or to meet our changing business requirements. When we update our Terms and Conditions, we will take appropriate measures to inform you, consistent with the significance of the changes we make. Any updates or amendments will be posted on the Invicta Health website:

Definitions

  • “Invicta Health Learning”, “IHL” or “Invicta Health” means “Invicta Health Community Interest Company” (“IH CIC”)
  • The “Client(s)” means the person(s), delegate(s), company(ies) or other legal entity(ies) identified as providing a request to Invicta Health Learning to supply “Services”
  • “Services” means the goods or services to be provided by Invicta Health Learning to the “Client” under the terms of the agreement
  • “Training Provider” means the company delivering a course when this is not Invicta Health.
  • “Contract” means the training request or any other request for services
  • “Venue” meaning either the location booked by IHL to facilitate this course or the location specified by the client for on-site training
  • “LMS” – Learning Management System
  • “Linked Sites” - links to pages on other websites

1. Registration with the Invicta Health Learning Management System

All delegates need to register with the IHLMS before any courses or e-learning can be accessed. All eligible delegates must provide:

  • Name
  • Designation (including any specific duties i.e. Safeguarding Lead)
  • Place of Work
  • Contact details (e.g. email address)
  • Special requirements (we will make every effort to accommodate special requirements that have been specified when booking)

(Please note: For some tutor led sessions there are eligibility/pre course questionnaires)

It is the delegate’s responsibility to provide Invicta Health with true, accurate, current, and complete information about themselves and ensure timely updates.

Any medical conditions or disabilities which may affect a delegate’s full participation in a course, must be disclosed during all course registration processes so appropriate support is arranged. Requests for exceptional circumstances where information regarding pre-existing conditions has not been disclosed will not be accepted.

By using the IHLMS, the delegate agrees to register and be bound by these Terms and Conditions, which shall take effect immediately on the delegate’s first use of the Site. If the delegate does not agree to be bound by all the following Terms and Conditions, they should not complete their registration.

1.1 Responsibility of the listed Practice Manager/Line Manager

It is the responsibility of the listed Practice Manager / Line Manager to ensure that the list of delegates found within “My Team” within the IHLMS is an accurate and up to date record of those currently employed or aligned to their surgery.

Invicta Health will regularly request that listed managers check the “My Team” tab and update us of any incorrect information and of staff leavers.

1.2 Eligibility

The service is only available to delegates from Kent and Medway General Practices who contribute to the training levy or work within a Primary Care Network (PCN) in Kent and Medway to support delivery of core services.  

Invicta Health provides training to non-medical clinical and non-clinical staff.

Invicta Health does not provide training to GPs. However, GPs can access e-Learning and attend in-house Basic Life Support training sessions, if space allows; however, a practice must not request Basic Life Support training to cater solely for the training requirements of GPs.

1.3 Data Management

Invicta Health reserves the right to delete delegate’s accounts without notice (called purging) if Invicta Health has determined that they are no longer in use. Invicta Health will review accounts monthly to determine whether they are active or no longer in use.

1.3.1 Accounts will be suspended if:

  • We have been notified a delegate has retired and is no longer working within the NHS
  • We have been notified a delegate has left the Kent and Medway area or are no longer working for a levy paying practice
  • A delegate has not logged in to their account 18 months from the date of monthly review and there has been no communication from the employing practice
  • A profile has incomplete or missing information such as an invalid email address or place of work

1.3.2 On suspension the training history of the delegate will be copied and sent to the GP practice to be retained on the delegate’s HR file, following the GP practices’ retention schedules.

1.3.3 Accounts will be purged when:

  • Six months following account suspension
  • We have been notified that a delegate is deceased
  • An account is created and there are no logins made within two months of creation

2. Data Protection

Your data will be stored within the IHLMS, this system is provided by Learning Pool and complies with the requirements of the ISO 27001:2013 standard. Your data will only be used for the purposes of coordinating training, skills analysis, compliance and reporting against contractual requirements. Your data therefore may be shared with relevant and appropriate stakeholders.

Invicta Health Learning will take security measures to protect all personal information in storage and will only pass on this information to enable the delivery of training.

Delegates have the right to withdraw consent for the IHLMS to hold their details. If consent is withdrawn, their details will be permanently erased and permanently forgotten. If this is requested, delegates should note that they will no longer be able to access training. Training information will be sent to the employing practice to be held on their HR file.

In accordance with the Data Protection Act 2018, if at any time you no longer wish to receive communication from Invicta Health Learning either by post or e-mail, or would like to be removed from IHL’s database (this can occur after completion of any courses you are enrolled in), please contact please contact us online or by phone (click here to be taken to the Contact Us section of our website)

3. Ownership and intellectual property rights

All intellectual property rights in all materials developed by Invicta Health, including the design, graphics and text of all printed materials, the audio of all webinars and podcasts, are owned by Invicta Health and should not be used to recreate personal training. When delegates are given access to the IHLMS, they are granted a non-exclusive, non-transferable, revocable licence to use Invicta Health materials.

No Invicta Health content may be; copied, reproduced, uploaded, posted, displayed or linked to in anyway, in whole or in part, without Invicta Health’s prior permission.

Delegates may not allow anyone else to access the IHLMS via their log-in details; any such use is strictly prohibited and will constitute an infringement of Invicta Health intellectual property rights.

4. Linking to other sites

The IHLMS may contain links to pages on other websites (“Linked Sites”), and those linked sites may contain content or offer products and/or services for sale.

We do not author, edit, control, or monitor these linked sites. It is your responsibility to verify any source data. We have no responsibility for the accuracy or availability of information provided by linked sites; and we do not control or endorse the sponsors of such linked sites, or the content, products, advertising, or other materials presented on such linked sites.

We may remove any links to linked sites from the website at any time for any reason.

We will not be liable for any transactions conducted by you with third parties through any linked site or for any liability arising from any representations or information provided on such linked sites.

The fact that we have linked to any linked site does not create or imply any relationship or partnership between us and the operator of such linked site.

5. Technology

Invicta Health does not warrant that the provision of any content online will always be available or be uninterrupted, timely or error free, that defects will be corrected or that such content is secure or free from bugs, viruses, errors and omissions.

6. Booking a training or e-learning course

When a delegate signs up to a course or a workshop via the IHLMS their booking acts as an agreement to Invicta Health that they will attend the course and have acquired all relevant authorisation such as:

  • Confirmed this training is suitable and in line with the delegate’s agreed learning and development
  • Received authorisation for attendance and time out of practice from their line manager
  • Have completed any pre-requisites e.g. eligibility assessments and have appropriate post training support in place, i.e. mentor/supervision
  • Invicta Health has the right to refuse any delegate admission on, or continuance with, any course, at its discretion.

6.1 Events outside of our control

If an event outside of our control takes place that affects the performance of our obligations:

  • We will contact you via email as soon as reasonably possible to notify you; and
  • We will notify your listed Line Manager/Practice Manager
  • We will resume the services as soon as reasonably possible after the event outside out control is over

An event outside our control includes, but is not limited to, any unforeseeable circumstance or circumstance that is beyond our reasonable control.

7. Health and safety at training courses

Delegates must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at our training venues. Invicta Health are not liable for loss or damage to property or injuries from accidents whilst attending our training.

8. Behaviour

Delegates attending training courses are expected to engage in a positive manner and to participate in activities and feedback.  Please be aware that individual issues, concerns, and cases cannot be fully explored in training sessions, and it may be more appropriate to seek further input outside the training session.  Delegates are also expected to respect their fellow participants and not to dominate or attempt to redirect the training to meet personal objectives or interests at the expense of others.  Delegates are also asked to cooperate fully with reasonable requests from trainers or the training venue.

9. Trainers

Invicta Health ensures trainers are quality checked and all qualifications are verified. Invicta Health ensures all training provided complies with national regulation or recognised best practice. 

10. Liability

10.1 Theoretical Training

For theoretical training requiring practical competency sign off (e.g. a clinical technique), Invicta Health are not responsible for the competency sign off and are not liable for any act which my result in a clinical incident.

10.2 Use of IHLMS

Invicta Health do not guarantee that:

10.2.1. use of this IHLMS will be compatible with all hardware and software

10.2.2. use of this IHLMS will be uninterrupted or error or virus free

10.2.3. use of this IHLMS will deliver any specific outcome for its users

 You must take appropriate steps to ensure that you regularly check for viruses when using IHLMS on any device.

11. Late cancellation

Delegates can cancel their place on a course or workshop up to 5 working days before the start date without repercussion.

If a delegate withdraws less than 5 working days before the start date of a course, without offering a replacement delegate, this will be classed as a late cancellation as Invicta Health will not have been given sufficient notice to fill this place. Replacement delegates must be notified to Invicta Health at least 48 hours prior to the course start date.

Notification of late cancellation must be submitted in written form to: learning@invictahealth.co.uk.

Non-attendance of a workshop or course without prior notification to Invicta Health will be classed as a DNA (did not attend). The delegates passport of learning will be updated to reflect this, and the delegates line manager will be informed.

If cancelation is due to trainer sickness, adverse weather or failure to reach minimum delegate requirements, Invicta Health reserves the right to cancel a training course at any time. In such circumstances, we will offer alternative dates or a full refund if appropriate.

12. Unauthorised attendance

Delegates attempting to attend a course without confirmed booking or who are not eligible will be turned away by the trainer. 

13. Leaving your practice

Delegates leaving the Kent and Medway area or leaving to join a non-levy paying practice within Kent and Medway must inform Invicta Health, so their account can be suspended (see 1.3 Data Management).

We recommend that leavers print their passport of learning and download certificates for their records. A copy will be sent to the delegate’s practice that they are leaving, to be retained on their HR file in accordance with the practice’s retention schedules.

If a delegate fails to inform us and we receive notification from a Practice Manager that a delegate has left their practice, Invicta Health will, without notice, suspend the delegate’s account and cancel all places they have booked onto upcoming courses.

Delegates are reminded that all account information will be purged six months after suspension.

14. Fees

No payments are required directly to Invicta Health to access training provided by the IHLMS as this is covered by the voluntary training levy.

15. Compliments and complaints
